No Injunction Granted: Effort To Halt GOB – SMART Contract VIA Judicial Review, Quashed

On Thursday, March 3, 2022, in the Belize Supreme Court, Justice Sonya Young decide that an application for judicial review of a contract worth $3.4million that was awarded by the Government of Belize to SMART Telecommunications will remain with the company.

The request for judicial review was filed by Senator Michael Peyrefitte and the United Democratic Party, and argued by former PM & Attorney Dean Barrow; he sought to place an injunction on the awarding of the contract to SMART Telecommunications.

Several companies, including Belize Telemedia, and at least 2 other potential suppliers had submitted bids for the lucrative contract to provide software (Microsoft 365) to the government, under a 1 year agreement.

In Her Decision

“Justice Young found that the BZ$3.4-million-dollar contract awarded to SMART for Microsoft 365 licenses for a period of one year was validly and rationally entered into with the government. Additionally, she noted that the bid was the lowest and that there was no bias or appearance of bias associated therewith. Justice Young further underscored the importance of competition for the benefit of the Belizean people”.
